LOGITAS deposit information subscription agreement This Agreement is optional and may be signed by an End User or Authorized Third Party (See Deposit Information Subscription agreement). An End User having a valid Licence is de facto protected by the relevant Deposit, even if this End User is unknown to LOGITAS. Subscribing to the LOGITAS Deposit Information Subscription Agreement will provide a Licensee the following: aReceiving of an up to date Logitas deposit certificate twice a year for every software property he is concerned by and with a note mentioning any potential problems. See hereinafter Annexe 5. aBe warned by registered letter with acknowledgment of receipt when a "Permanent default" occurs or when the Depositor intends to withdraw all or part of the deposited material, for example an old version on which the Licensee may still be subject to a Tax department or regulating authority enquiry. LOGITAS undertakes to keep the concerned deposited material for at least 12 months from the date of reception of the LOGITAS registered letter, during which period the Subscriber will be entitled to ask for a release, find a replacement provider or simply request the Depositor to keep it deposited, if even at the Subscriber's expense. aWhen dealing with large companies, LOGITAS can more frequently mail or email an Excel spreadsheet indicating the status of current and pending deposits. In many cases there is a long delay between the signature of the contract and the definitive acceptance of the software. The Licence agreement is usually established by the buyer or the legal advisor and experience shows they are rarely in a position to verify the completion of the Escrow provisions. Remark: The LOGITAS Deposit Information Subscription Agreement includes definitions from the LOGITAS Standard Escrow Agreement. This LOGITAS Deposit Information Subscription Agreement is also included as an annex to each LOGITAS Escrow Agreement. It will therefore be that included version which is offered to the relevant End Users, even if the standard LOGITAS Escrow Agreement has since been updated.
