Storage of successive deposits
and updates via stockpiling
This activity comprises the storage and release of Deposits. Deposits are stored in duplicate in two geographically distinct locations and can be permanently or temporarily returned according to predefined contractual procedures, or because the Depositor needs access to a particular version of the software that he cannot find in his own archives (believe us - it happens). Predefined procedures may involve release to an End User or Authorized Third Party according to the LOGITAS Standard contractual release procedure or any specific release procedure contractually agreed by both the Depositor and his End User or other stakeholder.
Stockpiling the successive versions, specific developments and platforms, etc. will allow:
a Simultaneous protection within the framework of a single LOGITAS Escrow Agreement of all the End Users and Authorized Third Parties, independently of the version they are running, provided all of these versions are included in the deposit. The most appropriate means of covering all versions is to include the Configuration Management System database in the deposit.
a Creation of a solid body of evidence of ownership of the IT asset,
a To satisfy the requirements of an regulating authority such as the SEC, FDA, COB or IRS, even if the particular version involved is unused or unsupported but whose output data may be pertinent in an investigation.
LOGITAS stores the two copies of each deposit in fire, water and theft resistant vaults in two distinct locations that are at least 5 km apart.
LOGITAS has insurance protection to cover all costs associated with reproducing one vault from the other should one vault suffer fire or water damage, theft or any other prejudice.
In case of the termination of a LOGITAS Escrow Agreement, either by the Depositor or by LOGITAS, the deposited elements will be stored by LOGITAS for one year. The deposit will remain accessible to an End User or Authorized Third Party during that one year period according to the LOGITAS Standard Release Procedure or according to the specific release procedure previously agreed to by both Depositor and End User or Authorized Third Party.
